INTRODUCTION

This Privacy Policy applies to all websites and mobile applications (each a “Site”) operated by RUN Hargett RUN, LLC and its affiliates (“Hash House”, “Hash House A Go Go”, “we”, “us”).  This Privacy Policy explains how we collect, use, disclose, and safeguard your information we obtain we you through our Sites, including but not limited to information obtained through any promotional program or service provided (in whole or in part) through any Site.

Please read this privacy policy carefully before accessing any of our sites. By accessing any of our Sites, you agree to the terms of this Privacy Policy. 

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification. 

You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted. 

COLLECTION OF YOUR INFORMATION

We may collect information about you in a variety of ways. The information we may collect on the Site includes:

Participation in Our Programs:

When you register and/or participate in any of our programs on our Site, you will be asked to provide some personally identifiable information, such as but not limited to: name, shipping address, email address, telephone number, date of birth/age. As you various activities related to a Site, such as which of our restaurants you visit, rewards earned, promotions redeemed, any expressed preferences, or engagement with our brand(s). You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site [and our mobile application].

Online Purchases

We will only collect the information necessary to facilitate transactions such as credit card or debit card numbers, associated security codes, billing address, email address, telephone number. Financial information is only stored by our payment processors and you are encouraged to review their privacy policy and contact them directly for responses to your questions. 

Promotions

We may collect information about you when you participate in a promotion that we sponsor, such as a contest or sweepstakes (which we may sponsor alone or co-sponsor with one or more third parties). To participate in one of our promotions, you may be asked to provide your name and your email address, mailing address and/or other contact information. Participation will be subject to the promotion’s official rules (as well as this privacy policy and the privacy policy of any co-sponsor).

Careers

If you choose to explore career opportunities by providing information on our Site, you will be asked for contact information as well as information about your employment and  educational history and other relevant information. This portion of our Site may be operated by a third-party service provider collecting the information on our behalf.

Correspondence

If you sign up on one of our Sites to receive email communications or other correspondence from us, you may be asked to provide us with your name, email address, and/or mailing address, along with other information related to your subscription or correspondence.

Social Networking

Our Sites may include the ability for you and other users to link to various social networking platforms. We may receive information about you when you choose to post or otherwise share information about us on any social networking platform. Note that any information that you or others post to a social networking platform will be accessible by any users of such platform, subject to its terms of service and privacy policy.

Usage Data

When you use or access any of our Sites, we may collect certain usage data generated by your activities on the Sites, including your pages viewed, number of bytes transferred, hyperlinks clicked, and other actions you take on our Sites. This information may also include your Internet Protocol (IP), device name and type, your operating system, your phone number, your country, your likes and replies to a post, and other interactions with the application and other users via server log files, as well as any other information you choose to provide.

As with most websites, we may employ “cookies,” web beacons, or similar technologies on our Sites to collect and store certain information about usage by visitors to our Sites, to improve our services and advertising, and to help us remember you and your preferences when you revisit our Sites. If you block cookies there may be pages on our Site you will not be able to access.

When you submit an inquiry or otherwise correspond through one of our Sites, you may be asked to provide your name, email address, and/or other personal information to us.

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. We may use information about collected about you through our Sites for a variety of commercial purposes. Without limitation, information collected may be used to:

  • Increase the efficiency and operation of the Site and our mobile application;

We keep the information about you collected through our Sites in compliance with applicable laws and regulations and until we no longer have a business need for retaining it.

DISCLOSURE OF YOUR INFORMATION

We may disclose any of information we have collected about you in certain situations. Your information may be disclosed as follows:  

  • When you request or authorize the disclosure;
  • When the information is provided to help complete a transaction for you;
  • When the information is provided to one or more of our agents, outside vendors or service providers to perform functions on our behalf (such as to analyze data, provide marketing assistance, provide customer service, and/or to process orders);
  • When the information is collected by third-party ads, content or technologies integrated with any of our Sites;
  • when the information is provided to one of our partners or other third parties for their own marketing or other commercial purposes;

  • as otherwise described in this Privacy Policy.

POLICY FOR CHILDREN

We do not knowingly solicit information from or market to children under the age of 13 through our sites or mobile application. If we learn that any unauthorized personal information of a child has been collected, we will take appropriate steps to delete such information. If you are a parent or guardian and discover that your child has provided any such personal information to us, then you may contact us at the email or mailing address noted at the end of this Privacy Policy below and request that we delete that information from our systems.

CALIFORNIA PRIVACY RIGHTS

This section applies only to California residents. 

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), below is a summary of the “Personal Information” categories, as identified and defined by the CCPA (see California Civil Code section 1798.140 (o)), that we collect, the reason we collect your Personal Information, where we obtain the Personal Information, and the third-parties with whom we may share your Personal Information.

We generally collect the following categories of Personal Information about your when you use our Site or services:

  • Identifiers such as a name, address, unique personal identifier, email, phone number, your device’s IP address, software, and identification numbers associated with your devices.
  • Protected classifications, such as gender.
  • Commercial information such as records of products or services purchased, obtained, or considered by you.
  • Biometric information.
  • Internet or other electronic information regarding you browsing history, search history, the webpage visited before you came to our Site, length of visit and number of page views, click-stream data, locale preferences, your mobile carrier, date and time stamps associated with transactions, and system configuration information.
  • Your geolocation, to the extent you have configured your device to permit us to collect such information.
  • Audio recordings of your voice to the extent you call us, as permitted under applicable law.
  • Professional or employment-related information.
  • Inferences about your preferences, characteristics, behavior and attitudes.

We generally do not collect education-related information. For more information about the Personal Information we collect and how we collect it, please refer to the above sections. 

We collect your Personal Information for the business purposes described above. The CCPA defines a “business purpose” as the use of Personal Information for the business’s operational purposes, or other notified purposes, provided the use of Personal Information is reasonably necessary and proportionate to achieve the operational purpose for which the Personal Information was collected or another operational purpose that is compatible with the context in which the Personal Information was collected.

The categories of third-parties with whom we may share your Personal Information are listed in above.

Privacy Rights

If you are a California resident, you have rights in relation to your Personal Information; however, your rights are subject to certain exceptions. For instance, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information, your account with us or the security of our network systems.

  • Right Against Discrimination. You have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising your right to know, delete or opt-out of sales.
  • Right to Know. You have the right to request in writing: 
  • a list of the categories of Personal Information, such as name, address, email address, that a business has disclosed to third-parties during the immediately preceding calendar year for the third-parties’ direct marketing purposes; 
  • the names and addresses of all such third-parties. 
  • the categories of Personal Information we have collected about you;
  • the categories of sources from which Personal Information is collected;
  • the business or commercial purpose for the information collection;
  • the categories of third-parties with whom we have shared Personal Information;
  • the specific pieces of Personal Information we hold about any individual;
  • You have the right to request a copy of the specific Personal Information we collected about you during the 12 months before your request.
  • Right to Delete. You have the right to request us delete any Personal Information we have collected from you or maintain about you, subject to certain exceptions.


To assert your right to know or your right to delete your Personal Information, please contact according to the “Contact Us” section below. To verify your identity, we may ask you to verify Personal Information we already have on file for you. 

If we cannot verify your identity from the information we have on file, we may request additional information from you, which we will only use to verify your identity, and for security or fraud-prevention purposes.

  • Right to Opt-Out of Selling. As described in this Privacy Policy, in certain situations we may share your Personal Information with our partners, third-parties or affiliates for our marketing or other purposes.

To the extent such sharing is considered a “sale” under the CCPA, as a California resident you have the right to opt-out of such sharing. If you would like us to no longer share your Personal Information in this way, please contact us. If you opt-out, we may be unable to offer you some of our Services which require sharing of Personal Information.

In addition, California Civil Code Section 1798.83 permits customers to request certain information regarding our disclosure of Personal Information to third-parties for their direct marketing purposes. In your request, please specify that you want a copy of our California Privacy Rights Notice.” Please allow 30 days for a response.

LINKS TO THIRD-PARTY SITES

There may be links on our Sites that will take you to third-party sites. Please be aware that we do not control any such third-party sites, and we are not responsible for the contents of any third-party site or any link contained in such a site. The inclusion of any link on one of our Sites does not imply endorsement of the third-party site. The use and privacy practices of the operator of any third-party site as to any information you provide is in no way subject to this Privacy Policy. Each third-party site may have its own policy that could differ considerably from our Privacy Policy, or the third-party site may not display any privacy policy at all.

We use reasonable technical, administrative, and physical measures to protect information contained in our systems against misuse, loss, or alteration. Please note, however, that no method of electronic transmission or storage is 100% secure. If we receive instructions using your log-in information, we will assume that you have authorized such instructions, so please keep your username and password secure.
